Terms of service

These Terms of Service (“Terms”) govern your use of the digital platforms, websites, donation portals, fundraising tools, event registration systems, and other online services operated by Kids Help Phone Foundation (“KHP Foundation,” “we,” “us,” or “our”). By accessing or using any KHP Foundation service, you agree to be bound by these Terms.

KHP Foundation is a registered charity established to support the fundraising activities of Kids Help Phone). KHP Foundation does not directly provide mental health services, crisis counselling, or clinical programs.

1. About KHP Foundation Services

KHP Foundation’s digital services include, but are not limited to:

• Fundraising platforms, which include Donation, event registration, peer-to-peer fundraising tools and campaign pages
• Event ticketing platforms
• Email, newsletter, and donor communications platforms
• The KHP Foundation website and associated web properties
• Surveys and donor feedback tools

These Terms apply to all such services. Any platform-specific terms will be communicated at the point of use and form part of these Terms.

2. Donations

2.1 Processing

All donations made through KHP Foundation platforms are processed by our authorized payment partners. Donations are non-refundable, except in limited circumstances such as processing errors or as required by applicable law, and subject to KHP Foundation’s Gift Acceptance Policy and Canada Revenue Agency requirements

2.2 Tax Receipts

KHP Foundation is a registered charity under the Income Tax Act (Canada). Official tax receipts are issued for eligible donations in accordance with Canada Revenue Agency guidelines. Receipts are sent to the email or mailing address provided. It is the responsibility of the donor to ensure their contact information is accurate and up to date.

Payments associated with sponsorships, event participation, or other benefits may not be eligible for a tax receipt.

2.3 Refunds and Errors

 All refund requests are reviewed on a case-by-case basis and granted only where appropriate in accordance with KHP Foundation’s Gift Acceptance Policy and applicable CRA requirements. If a donation was made in error or a charge made incorrectly, please contact us at [email protected] within 30 days of the transaction.

2.4 Recurring Donations

By setting up a recurring donation, you authorize KHP Foundation to charge your payment method at the selected frequency until you cancel. You may cancel at any time by contacting us at [email protected] with reasonable notice before the next scheduled charge.

3. Fundraising and Events

Individuals and organizations may create peer-to-peer fundraising pages or participate in KHP Foundation events subject to the following:

• All funds raised on KHP Foundation digital platforms will be directed to KHP Foundation for the benefit of Kids Help Phone.

4. Acceptable Use

When using KHP Foundation services, you agree not to:

• Provide false, inaccurate, or misleading information
• Impersonate any person or organization, including KHP Foundation or Kids Help Phone
• Use our platforms for unauthorized commercial solicitation
• Attempt to gain unauthorized access to our systems, data, or infrastructure
• Transmit malicious code, spam, or unsolicited communications
• Engage in conduct that could harm the reputation of KHP Foundation or Kids Help Phone

KHP Foundation reserves the right to suspend or terminate access for any user who violates these Terms.

5. Intellectual Property

All content on KHP Foundation platforms—including text, images, logos, graphics, videos, and campaign materials—is the property of KHP Foundation or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or use our content for commercial purposes without our prior written consent. Limited personal, non-commercial use (such as sharing a fundraising page) is permitted where expressly supported by our platforms.

6. Privacy

KHP Foundation is committed to protecting the personal information of donors, volunteers, and all individuals who interact with our platforms. The collection, use, and disclosure of personal information is governed by our Privacy Policy.

By using KHP Foundation services, you acknowledge that personal information provided to us will be handled in accordance with the Privacy Policy and applicable Canadian privacy legislation, including PIPEDA and applicable provincial privacy laws.

7. Communications and CASL

KHP Foundation sends commercial electronic messages (CEMs) including fundraising solicitations, event announcements, newsletters, and donor updates only where we have your express or valid implied consent, as required by Canada’s Anti-Spam Legislation (CASL).

8. Third-Party Platforms and Links

KHP Foundation uses or links its portal to third-party platforms for payment processing, event management, email delivery, or fundraising tools. All service providers are contractually required to process information only for specified purposes, implement appropriate security safeguards, and maintain confidentiality.

9. Changes to These Terms

KHP Foundation may update these Terms from time to time to reflect changes in our services, legal requirements, or organizational practices. Material changes will be communicated to stakeholders with the effective date clearly indicated.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising out of or in connection with these Terms are subject to the exclusive jurisdiction of the courts of Ontario.
